When an immigration judge or the Board of Immigration Appeals (BIA) issues an unfavorable decision in your case, you may have the option to file a motion to reopen or a motion to reconsider. These legal remedies provide an opportunity to present new evidence or argue that the decision was legally incorrect.
A motion to reopen asks the court or BIA to reexamine your case based on new facts or evidence that was not available and could not have been discovered or presented at the original hearing. This motion must generally be filed within 90 days of the final administrative decision, though exceptions exist for asylum cases based on changed country conditions and certain other circumstances.
A motion to reconsider asks the court or BIA to review its decision based on incorrect application of law or policy to the facts of your case. This motion must be filed within 30 days of the decision and must identify the errors of fact or law in the prior decision.
